Warshaw - On 8 July 2000, the Council of Ministers (i.e. the Cabinet) approved the Background Document on new Act on Wastes which provides for transposition of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives being the framework legal act regulating waste management issues within the Community.

According to the Directive, selective system for collection of waste such as at least paper, metal, plastic and glass has to be introduced throughout the Community by 2015. By 2020, the preparing for re-use and the recycling of waste materials such as paper, metal, plastic and glass from households and possibly from other origins as far as these waste streams are similar to waste from households, should be increased to a minimum of overall 50 percent by weight. By the same year 2020, the preparing for re-use, recycling and other material recovery, including backfilling operations using waste to substitute other materials, of non-hazardous construction and demolition waste excluding naturally occurring material defined as soil and stones containing dangerous substances have to be increased to a minimum of 70 percent by weight.

The Polish proposal for new Act on Wastes defines new category of bio waste, and natural and legal persons responsible for waste management, such as waste producers, holders, brokers, dealers, transporters and collectors, establishments or undertakings which carry out waste treatment operations, and also the procedure measures which may be adopted to determine the criteria to be met for specific substances or objects to be regarded as a by-product and not as waste. The proposal includes a wider description of the methods for conduct of waste and the activities consisting in preparation of waste for re-use and recycling thereof.

The changes set forth in this new Act on Wastes will firstly have effects on the aforementioned entities and also the administrative authorities dealing in waste management sector under the relevant provisions concerning waste.
